Baptist Health System Inc. (Baptist Health) in Florida has agreed to pay $1.5 million to settle allegations of violating the False Claims Act by offering improper discounts to patients. The United States alleged that Baptist Health subsidiaries provided discounts without regard to financial need, potentially in exchange for referrals or purchases of services.

In response to the settlement, Principal Deputy Assistant Attorney General Brian M. Boynton stated, "The department will continue to rely on the False Claims Act to address the use of prohibited remuneration to induce federal healthcare business." U.S. Attorney Roger B. Handberg for the Middle District of Florida emphasized the importance of self-disclosures in protecting taxpayer-funded healthcare programs.

The resolution of this matter was a collaborative effort involving various government agencies, including the Justice Department, U.S. Attorney's Office, and the Department of Health and Human Services' Office of Inspector General. The government's focus on combating healthcare fraud was highlighted through this investigation and settlement.

The claims addressed in the settlement are allegations, and no liability has been determined. Baptist Health voluntarily disclosed the conduct, cooperated with the investigation, and implemented remedial measures, such as discontinuing the discount policy and enhancing compliance procedures.

The settlement serves as a reminder for healthcare providers to adhere to regulations and avoid improper practices that could impact federal healthcare programs. Reporting potential fraud or misconduct can be done through the Department of Health and Human Services' tip line at 800-HHS-TIPS (800-447-8477).

The handling of this matter was overseen by Trial Attorney Michael Hoffman and Assistant U.S. Attorney Carolyn Tapie. The resolution underscores the government's commitment to upholding the integrity of healthcare programs and holding accountable those who engage in fraudulent activities.
