Wendy's sued in Chicago slip and fall case
CHICAGO -- A Chicago woman has sued the Wendy's franchise in the Circuit Court of Cook County for injuries allegedly suffered when she slipped on a wet portion of the restaurant's floor.

The suit was filed in May and is currently in the discovery stages. Walker alleges that when she visited the Wendy's restaurant at 1623 W. Division St. in Chicago in August 2005, she was "caused to forcibly fall to the ground when walking upon the floor," leading her to suffer severe and permanent injuries.

The suit identifies 19 alleged breaches of duty by Wendy's, most of which amount to garden variety premises liability elements - failure to inspect, failure to warn, and failure to provide a safe area for patrons to walk. As a result of the fall, the suit alleges plaintiff suffered pain, disability, loss of a normal life and loss of income, as well as medical expenses. The plaintiff seeks an amount in excess of $50,000 in damages.

Chicago Title Land Trust, the titleholder of the property where the incident occurred, also is named as a defendant in Count II of the complaint.

Walker is represented by Jerome Schachter & Associates, Ltd., a Skokie, Ill. firm that focuses on personal injury, medical malpractice and worker's compensation claims. Jerome Schachter and Bruce W. Bublik are handling the case on Walker's behalf.

Wendy's is represented by Hinshaw & Culbertson, a national firm based in Chicago that specializes in corporate law and professional liability defense, among other areas of litigation.

The case is set for an initial case management hearing on Sept. 4, 2007, before Judge Jeffrey Lawrence in the Circuit Court of Cook County.
