CVS Pharmacy settles with Calif. AG; Agrees to $2 coupon policy

SACRAMENTO, Calif. (Legal Newsline)- CVS Pharmacy stores in California are required provide customers a $2 coupon if they identify products on store shelves that are past their sell-by date, under a settlement with the state attorney general announced Wednesday.

The agreement with Attorney General Jerry Brown also applies to Longs Drug Stores California, which CVS purchased last year.

The agreement settles claims that CVS stores routinely sold expired baby formula, over-the-counter medication and dairy products.

At a Huntington Beach, Calif., store, for instance, 11-months expired Gerber's Vanilla Custard was on store shelves. At a Fullerton store, Bright Beginnings Ultra Baby Formula that was three-months-expired was being sold.

A stipulated judgment was filed Wednesday in San Diego County Superior Court, the attorney general's office said in a statement.

As a part of the settlement, Woonsocket, R.I.-based CVS, a subsidiary of CVS Caremark, will pay $975,000 in civil penalties, attorney fees and costs.

The AG's investigation last year found that CVS Stores in Los Angeles, Orange, and San Diego counties had regularly sold expired products to consumers.

The investigation also found that five CVS Pharmacies had improperly discarded more than 500 documents and prescription bottles containing confidential medical information in dumpsters outside of its stores.
