CHICAGO (Legal Newsline) - Illinois Attorney General Lisa Madigan filed a complaint this week that will keep the swimming pool at a Metro-East hotel closed pending next month's hearing on alleged public health and sanitation violations.

Madigan obtained a temporary restraining order against ABVI Management Inc., the owner of America's Best Value Inn in O'Fallon, Illinois.

The matter had been referred to Madigan's office by the Illinois Department of Public Health after it said inspections revealed numerous ongoing violations of state public health and safety law.

"If you travel with children as I do, where's the first place they beg to go after check-in - the pool, of course," Madigan said.

"Travelers and parents shouldn't have to worry about hotel management not doing its job to keep pools safe, clean and free of hazards."

Madigan's complaint alleges that on Feb. 11 an inspector with the St. Clair County Health Department observed that the management of the hotel had reopened the swimming pool, removing the IDPH closure notice the agency had posted on Jan. 19. The notice had been posted for failure to address violations found during earlier inspections, she says.

Madigan's motion for a preliminary injunction will be held on April 6.
