Van Hollen wins case against developer

MADISON, Wis. (Legal Newsline) - Wisconsin Attorney General J.B. Van Hollen announced a summary judgment on Wednesday against a Waukesha County developer that allegedly failed to implement erosion controls.

In a civil complaint filed against Country West Development LLC by the Department of Justice in 2009, the developer was alleged to have failed to implement and maintain erosion control measures and to have discharged pollutants into a nearby wetland and brook. These alleged actions were violations of Wisconsin pollution laws.

The violations allegedly occurred at the 67.4-acre Fields Crossing residential real estate project in the town of Genesee, Wisconsin.

Country West Development was ordered by the court to pay total forfeitures and statutory penalties of $49,447 as a result of its alleged actions.
