CHICAGO (Legal Newsline) - Illinois Attorney General Lisa Madigan announced on a lawsuit on Thursday against a Bensenville, Ill., company over an alleged flood control work scam.

The lawsuit alleges that Eveready Flood Control and its president, Patrick Regan, of Roselle, defrauded customers out of contracted work to install flood control systems.

Madigan alleges that Regan's company completed little to none of the services it had been contracted for after consumers paid down payments, which is a violation of the Consumer Fraud and Deceptive Business Practices Act and the Home Repair and Remodeling Act.

"With spring being a popular time to make home repairs, this lawsuit should serve as an important reminder for homeowners to thoroughly scrutinize a contractor before signing any agreements," Madigan said.

Madigan's office had previously obtained $3,000 in restitution for a Cook County consumer affected by the alleged scam. The current lawsuit seeks $7,000 in restitution from the company.

The suit also asks that the defendant be prohibited from the home repair business in Illinois and the cancellation of any pending contracts with consumers.

The lawsuit seeks to impose a civil penalty of $40,000 on the defendant, additional penalties of $50,000 for each violation found to be committed with an intent to defraud and $10,000 per violation found to be committed against a person 65 years or older.
