Koster gets TRO against telemarketer

JEFFERSON CITY, Mo. (Legal Newsline) - Missouri Attorney General Chris Koster announced a temporary restraining order on Tuesday against a New York-based telemarketing company for alleged violations of the state's no-call laws.

Koster filed suit earlier this month against C. Michael Exteriors Inc. and William Bergmann, the company's owner. The lawsuit alleges that the defendants violated the Missouri Merchandising Practices Act and the Telemarketing No-Call List Act. Koster alleges that telephone solicitation calls were made to consumers in the St. Louis metropolitan area attempting to sell siding and windows.

"When Missourians register with our No-Call list, they do so with the reasonable expectation that they will not receive these unsolicited, harassing calls," Koster said. "These businesses are aware of our No-Call laws, and they are realizing that this office will enforce those laws."

The court specifically ordered C. Michael Exteriors to stop making calls to consumers on the no-call list.

In June, Koster announced agreements with the Palm Beach, Fla.-based J.E.C.C. LLC, the Florida-based Higher Response Marketing and the companies' managers over no-call law violations.

"The Attorney General's Office will continue to pursue companies who violate our telemarketing and phone solicitation laws," Koster said. "Missourians subscribe to our No-Call List to avoid being harassed by telemarketers. The law is clear, and I want Missouri citizens to know that this office will aggressively enforce the law."
