MADISON, Wis. (Legal Newsline) - Wisconsin Attorney General J.B. Van Hollen announced a complex forfeiture action on Wednesday against two companies and their principals for allegedly violating laws governing solicitations and misleading representations.

Grand Vacation Club Inc., William H. Bailey, Christy Spensberger and Travel Services Inc. allegedly violated certain provisions of Wisconsin's prize notices law when promoting and selling memberships in the Outrigger Vacation Club. The club does business as Travel Services Inc.

Bailey is a Carlinville, Ill., resident who has served as the president of Grand Vacation Club. Spensberger, also a Carlinville resident, is the president of Travel Services. Grand Vacation Club allegedly acted as an agent or an apparent agent of Travel Services and violated multiple Wisconsin laws related to solicitations and prize promotions.

The complaint, filed on Jan. 13, alleged that the defendants violated certain provisions in Wisconsin's Administrative Code governing mail and telephone solicitations. The complaint also alleges that the defendants violated certain provisions of state law concerning deceptive, untrue or misleading representations.

The complaint seeks a permanent injunction restraining the defendants from further violations of Wisconsin law, to require the defendants to pay restitution to all consumers for any loss or damages experienced, to declare all contracts with the two companies voidable by the consumers and to assess appropriate civil penalties and reasonable prosecution expenses.

Van Hollen's office brought the action on behalf the Wisconsin Department of Agriculture, Trade and Consumer Protection.
