NEW ORLEANS – A Louisiana woman claims a plumbing company’s negligence resulted in her injuries.
Plaintiff Nachell Maxwell, a Tammany Parish resident, filed her lawsuit in U.S. District Court for the Eastern District of Louisiana.
In the seven-page complaint, she alleges defendant Shur-Flow Services Inc., doing business as Mr. Rooter Plumbing, failed to properly repair a toilet at her place of employment.
In doing so, Maxwell alleges she slipped and fell on water that had accumulated on the floor.
“Having undertaken to inspect and repair the plumbing in the patient restroom, Defendant owed a duty to perform that work with the degree of reasonable care, skill, and competence expected of a professional plumbing contractor, and to avoid creating an unreasonable risk of harm to foreseeable third parties, including Plaintiff,” the complaint states.
According to Maxwell’s filing, a maintenance request, or ticket, was submitted to repair a plumbing issue in the patient restroom at her employer, Mint Dentistry in Orleans Parish.
In response, Mr. Rooter Plumbing was dispatched to the dental office on Feb. 5, 2026.
After completing its work, the defendant represented that the plumbing issue in the bathroom had been repaired and corrected, Maxwell claims.
However, shortly after, Maxwell alleges she slipped and fell on water that had accumulated on the bathroom floor. The water, she contends, was leaking from one of the toilet stalls that the company had allegedly repaired.
“As a result of the fall, Plaintiff landed on her right side, sustaining immediate and painful injuries to her right elbow and right knee, among other injuries,” the lawsuit states.
After, it was discovered that the toilet rim had not been properly sealed, and water was actively leaking from it onto the floor, Maxwell claims.
“The accumulation of water on the restroom floor was the direct and proximate result of Defendant’s negligent and defective plumbing repair work, including its failure to properly seal the toilet,” the suit states.
Maxwell seeks damages for: past and future physical pain and suffering; past and future mental anguish and emotional distress; past and future medical expenses;past and future lost wages and loss of earning capacity; permanent disability, impairment, and/or scarring; and loss of enjoyment of life.
