Invitee accuses apartment complex controllers of premises liability
HOUSTON — An invitee is suing Lake Kylasam Limited Partnership and Adara Communities LLC, apartment complex controllers, citing alleged negligence and premises liability.
Robert L. Lovelace filed a complaint on Feb. 13, in the Harris County District Court against the defendants alleging that they breached their duty to exercise ordinary care to keep the apartment complex premises in a reasonably safe condition.
According to the complaint, the plaintiff alleges that, in Feb. 13, 2017, he was visiting his son at defendants' Kingwood Lakes Apartment Complex in Kingwood. While descending a public flight of stairs, one of the stairs collapsed, causing him to fall onto the pavement. He sustained injuries to his neck. left shoulder, arm, hip, back and legs and was required to undergo surgery to fuse three of his lumbar vertebrae. The plaintiff holds Lake Kylasam Limited Partnership and Adara Communities LLC responsible because the defendants allegedly failed to remove, replace and/or repair the deteriorated stairway and failed to give adequate warning of the stairs unsafe condition.
The plaintiff requests a trial by jury and seeks monetary relief of more than $1,000,000 and such other and further relief to which he may be justly entitled. He is represented by Geoffrey S. Binney and Peter B. Pope of Gauntt, Koen, Binney & Kidd LLP in Spring.
