Harris County resident accuses Daniel & Associates LLC and David Patrick Daniel, Jr. of failure to pay overtime
HOUSTON — A legal assistant is suing Daniel & Associates LLC and David Patrick Daniel, Jr., a law practitioners, citing alleged violation of workers compensation acts.
Susan Cooper filed a complaint on Jan. 25, in the Houston Division of the Southern District of Texas against Daniel & Associates LLC and David Patrick Daniel, Jr. alleging that the law practitioners violated the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that, she regularly worked more than 40 hours per week, but she was not compensated at the FLSA mandated time-and-a-half rate for all hours worked in excess of 40 in a week. The plaintiff holds Daniel & Associates LLC and David Patrick Daniel, Jr. responsible because the defendant allegedly classified her as an independent contractor, failed to pay proper overtime compensation and made deductions to the pay of plaintiff for illness-related absences.
The plaintiff requests a trial by jury and seeks award for all unpaid overtime wages, liquidated damages, attorneys’ fees and costs, pre- and post-judgment interest and such other relief to which she may show herself to be justly entitled.
