MARSHALL - An East Texas jury has hit Samsung Electronics with yet another multi-million dollar patent infringement verdict – the third one in recent months.

On Sept. 26, the jury found that Samsung infringed upon a patent held by Anonymous Media Research Holdings, awarding the company $78,512,999 in compensation, court records show.

AMRH filed suit against Samsung on Sept. 22, 2023, in the U.S. District Court for Eastern Texas, Marshall Division.

According to the complaint, the infringement is over patents involving the commercial use of automatic content recognition (ACR) to enable targeted advertising, which has become an enormous business that continues to grow.

“By harnessing ACR technology in consumer electronics, such as smart TVs, companies like Samsung can listen to what its users listen to, and watch what its users watch,” the suit states. “The monitoring of a user’s listening and viewing activity usually involves the use of ‘fingerprinting’ algorithms, which capture representations (or fingerprints) of the audio or video data based on the content consumed by a user.

“As a result, ACR technology can obtain a comprehensive picture of a user’s media consumption, including information such as what you watch, when you watch it, and how long you watch it.”

Since at least 2015, Samsung has developed and used systems that implement ACR technology to collect and analyze data from Smart TVs and other smart devices, the suit states.

Among the patents Samsung allegedly infringed are the U.S. Patent No. 10,719,848, a claim jurors found that AMRH proved.

The Eastern District of Texas – a hot spot for patent litigation – has not been a favorable venue for Samsung this past year.

In May, an East Texas jury hit Samsung with a $111 million verdict, stemming from a lawsuit alleging Samsung infringed upon several patents owned by Maxell, a mobile electronics developer.

The month before, an East Texas jury levied a $279 million patent verdict against Samsung over the alleged infringement of wireless technology.
