CHARLESTON – West Virginia Attorney General JB McCuskey’s office is part a coalition of 48 states and territories announcing a $29.6 million settlement with Glenmark.
The settlement resolves allegations the generic drug manufacturer engaged in a widespread, long-running conspiracy to artificially inflate and manipulate prices, reduce competition, and unreasonably restrain trade with regard to numerous generic prescription drugs. West Virginia’s share of the settlement is $151,885.
As part of the settlement agreement, Glenmark will cooperate in ongoing multistate litigations against 33 corporate defendants and 25 individual executives. The company has further agreed to a series of internal reforms to ensure fair competition and compliance with antitrust laws.
The Glenmark settlement follows settlements with Lannett, Bausch, Apotex and Heritage totaling $66.95 million.
“This is another example of pharmaceutical companies putting profits over people. Glenmark conspired with other manufacturers to block competition, keeping prices high, and that is wrong,” McCuskey said. “It cost not only our healthcare system, but also our people who had to pay higher prices. I am thankful to be part of this bipartisan coalition working to hold this company, and others, accountable.”
Anyone who purchased a generic prescription drug manufactured by either Glenmark, Lannett, Bausch, Apotex or Heritage between May 2009 and December 2019 may be eligible for compensation.
