SHERMAN – A Texas man is suing a New York-based corporation of the use of the website domain name ``Yumiko.com,” under the belief that he is the registered owner of the name.

Stanley Pace filed a lawsuit Dec. 30. 2015 in the Sherman Division of the Eastern District of Texas against Yumiko, L.L.C. alleging a violation of the Anticybersquatting Consumer Protection Act (ACPA).

According to the claim, the domain name ``Yumiko.com” was originally registered in 1997 and pursuant to his business plan, Pace purchased and registered the domain name on or about Feb. 13, 2010.

Also, and according to the claim, on Dec. 9, 2015, the World Intellectual Property Organization rendered a decision requiring the transfer of the domain name to Yumiko, L.L.C. The domain name continues to be disabled, suspended and ``locked” pending the transfer of the registration to the Yumiko, L.L.C. on Jan. 4, 2016, pursuant to the Uniform Domain Dispute Resolution Policy.

Pace is seeking determination by the court that his registration and/or use of ``Yumiko.com” is not and has not been in violation of ACPA and his use of ``Yukimo.com” constitutes neither an infringement, a threat of dilution of Yumiko, L.L.C.’s trademark nor a violation of the ACPA.
