HOUSTON — A man is suing Academy claiming he tripped and fell while passing through a “congested” area of clothing racks.

Seeking up to $1 million in damages, Calvin Fields filed suit September 19 against Academy Sports and Outdoors in Harris County District Court.

According to the lawsuit, on October 3, 2024, Fields was shopping at Academy when he “encountered an area where clothing racks had been positioned unusually close together, leaving him with “insufficient space” to “safely pass through.”

“While attempting to navigate through the congested area, Mr. Fields’s pants became caught on one of the closely positioned clothing racks, causing him to trip and fall,” the suit states. “The condition of the clothing racks and the limited walking space created an unsafe condition for customers attempting to navigate the area.”

Fields is suing for his past and future medical expenses, pain, impairment and mental anguish.

He is represented by attorney Dustin Brown of the Plano law firm Stanley and Associates.

A local man is suing an apartment complex claiming his ceiling fell on him while sitting on the couch, burying him rubble.

Seeking more than $1 million in damages, Jared Simmons filed suit Septembe 21 against Mira Bella TX and Axial Living in Harris County District Court.

According to the lawsuit, on July 17 Simmons was sitting on the couch in his unit when the ceiling collapsed and crashed down onto him, “crushing him under the debris and rubble.”

“A good Samaritan neighbor rushed to Plaintiff’s aide, and pulled him from the rubble,” the suit states, adding that he was transported to the hospital via ambulance.

Simmons immediately felt pain throughout his back, shoulder and neck and still suffers from his injuries to this day, making it nearly impossible for him to carry on a normal and productive life.

Seeking exemplary damages, Simmons is alleging gross negligence, asserting the defendants were aware of the risk of harm yet acted with indifference to his welfare.

The Spagnoletti Law Firm in Houston represents him.
