CHICAGO — An Illinois corporation is suing Alzawrae Industrial Co., d/b/a Mazaya Tobacco, Mazaya USA LLC, and Wissam Amoudi, et al, a tobacco company, citing alleged breach of contract, breach of contract promissory estoppel (in the alternative), intentional interference of a valid contractual relationship or business expectancy, and other counts.
Lit Distributions Inc. and Yousef Nasereddin filed a complaint on Jan. 15, in the Cook County Circuit Court against the defendants, alleging they breached their contract with the plaintiff to be the exclusive distributor of Mazaya product in the Midwest region.
According to the complaint, the plaintiff alleges that on March 2017, Lit Distributions Inc. and Yousef Nasereddin were offered by defendants to exclusively distribute Mazaya in the Midwest Region, to which Nasereddin agreed. In October 2017, defendants allegedly allowed other parties to distribute in the Midwest. Nasereddin reportedly brought this to the attention of the individual who had assumed management of the U.S. operations for Alzawrae in Florida, but Nasereddin says Mazaya USA still refused to contact or conduct business with Lit.
Nasereddin sent an email to Mazaya USA's representative who, according to the complaint, continued to dishonor the agreement. The plaintiff holds Alzawrae Industrial Co., d/b/a Mazaya Tobacco, Mazaya USA LLC, and Wissam Amoudi, et al, responsible because Mazaya USA reportedly knew of the agreement between Alzawrae and Lit. Furthermore, pursuant to the agreement, Nasereddin claims Lit should be the exclusive distributor of Mazaya in the Midwest, in which the defendants have breached.
The plaintiff seeks defendants to pay $149,858 and restitution damages for the amount of $55,100. They are represented by Abraham Matthew of Matthew & Drnovsek Law in Chicago.
